From today's Argus Leader, Dan Scott's lawsuit against the Argus Mis-Leader's misleading "editorial" can go forward:
A Minnehaha County judge Friday denied a motion by the Argus Leader to dismiss a libel lawsuit brought against it by Dan Scott, president of the Sioux Falls Development Foundation.
Scott filed the suit against the Argus Leader and Executive Editor Randell Beck in August over a column Beck wrote about Scott's speech to those attending a Sioux Falls Area Chamber of Commerce event in June. That column included a satirical letter of apology from Scott. Circuit Judge Kathleen Caldwell's written decision states the Argus Leader's claim that Beck's column is protected by the First Amendment is not sufficient to keep the lawsuit from proceeding.
